employees, sysops, co-sysops, or other third parties, hereinafter
referred to as InterComm, Inc, are pleased to provide access to
the worldwide Internet.
The services provided by InterComm, Inc are provided without
warranties of any kind. There are no guarantees that the use of these
services will result in any benefits of any kind. In no event will
InterComm, Inc be held liable for any direct, indirect,
incidental, or consequential damages, including but not limited to lost
profits or opportunities, arising out of the use or the inability to use
these services, even if InterComm, Inc has been informed of the
possibility of such damages, or for any claims by any other party.
InterComm, Inc reserves the right to deny access to any
individual, or group of individuals, that violate the rules and
regulations of InterComm, Inc. InterComm, Inc's sole
liability to any individual, or group of individuals, whose account has
been terminated will be the refund of any unused portion of their
account fee.
Since there is not an absolute standard in computer operating systems or
hardware, InterComm, Inc cannot guarantee that any web pages or
sites created by InterComm's customers will work or function properly on
InterComm software or hardware. It is the customer's responsibility to
correct or modify any source code. Customer's may not use or distribute
copyrighted material on InterComm hardware without the written consent
of the copyright holder. With thousands of third party Internet programs
in existence, InterComm cannot test or guarantee that third-party
software will work or function properly with InterComm's software or
hardware.
InterComm, Inc is connected to the worldwide Internet network,
and as such, provides access to the Internet for InterComm's
subscribers. Virtually any kind of information or material is available
somewhere on the Internet. Since InterComm, Inc is not in control
of the Internet or its content, including information and material that
may be considered objectionable by some subscribers, InterComm cannot
block, screen, or censor material a subscriber may find offensive.
InterComm, Inc is only a gateway or a door to the Internet.
InterComm, Inc cannot guarantee access or deny access to any part
of the Internet based on the user's age or any other factor. Be advised
that possession of some material (legal in other countries of the world)
is a violation of United States Law, and, similarly, transmission of
some material, including but not limited to, cryptographic algorithms
and encryption software, by United States citizens or others from
within the physical boundaries of the United States outside those
boundaries may be a violation of United States Law.
InterComm will update this agreement as required. The latest version
will be posted at this URL, http://www.intercomm.com/disclamer.html. By
accessing InterComm's services, the subscriber agrees to be bound by the
latest version of this agreement.
Therefore, in no event will InterComm, Inc be liable to anyone or
any entity as a result of any objectionable or illegal material,
including but not limited to pornography, copyrighted or commercial
software, or any other material, that may have been retrieved from the
Internet through the facilities of InterComm, Inc. Any person or
entity that accesses the Internet through InterComm, Inc does
hereby agree to indemnify and hold harmless InterComm, Inc from
and against any liability to anyone or any entity that may arise due to
such person's or entity's access of the Internet thorough InterComm, Inc.
This includes, but is in no way limited to, fees assessed for the use of
any Corporation by any person or entity who accesses said service
through InterComm, Inc.
